LIMITED WARRANTY
1. What This Warranty Covers And For How Long:
ADVANTAGE BOATS, INC. ("ADVANTAGE") warrants each
ADVANTAGE boat against substantial defects in materials and workmanship
under normal use and service for a period of three (3) years
from the date of purchase by the original retail purchaser. ADVANTAGE
will, at no charge, repair the boat during the warranty period
provided it is returned in accordance with the terms of this
warranty and the conditions hereof.
2. Warranty Conditions:
This express limited warranty is extended by ADVANTAGE to
the original retail purchaser of the boat only and is not assignable
or transferable to subsequent purchasers or lessees. This is
the complete warranty for the ADVANTAGE boat and ADVANTAGE assumes
no obligation or liability for additions or modifications to
this warranty unless made in writing and signed by an officer
of ADVANTAGE.
3. What This Warranty Does Not Cover:
This warranty does not cover the following: (a) defects or
damage resulting from the use of the boat in other than its normal
and customary manner; (b) defects or damage from misuses, accident
or neglect; © defects or damage from improper operations,
maintenance, adjustment, or any alteration or modification of
any kind; (d) a board repaired, without ADVANTAGE's written authorization,
in such a manner as to adversely affect performance or prevent
adequate inspection and testing to verify any warranty claim;
(e) any boat used for racing, or used for rental or commercial
purposes; (f) any boat operated contrary to ADVANTAGE's written
instructions or in violation of federal or state laws; (g) defects
or damage to any trailer used to transport the boat or to any
articles, fixtures, furnishings, parts, accessories or property
contained in, incorporated into, or attached to the boat that
was not manufactured by ADVANTAGE in its manufacturing facility
such as, but not limited to, engine, outdrive, controls and propeller;
(h) defects or damage to any part of the boat that is warranted
in writing by manufacturers other than ADVANTAGE (copies of such
warranties will be provided on request); and (i) defects or damage
to chrome, gel coat or anodized finishes.
4. How To Get Warranty Service:
If something goes wrong within the warranty period and you
believe that the warranty should be activated, contact the ADVANTAGE
dealer from whom the boat was purchased and arrange a mutually
convenient time for a dealer service representative to inspect
the boat at the dealer's facility or location at which you took
delivery of the boat or at another mutually agreed site. If the
dealer cannot correct the problem you should contact ADVANTAGE
directly in writing outlining your grievance at the following

After reviewing the written grievance, ADVANTAGE will, at
its option, send a representative to the dealer's site from which
you purchased the boat to inspect the defects or damage and to
authorize repair locally. If the defects or damage cannot be
corrected locally in the sole opinion of ADVANTAGE, the original
retail purchaser will prepay transportation charges of the boat
or defective or damaged parts thereof to the manufacturing facility
of ADVANTAGE. If the defects or damage are warranted hereunder,
ADVANTAGE will repair the defects or damage and prepay transportation
charges back to the dealer's site from which you purchased the
boat for pickup by the original retail purchaser unless another
delivery site is otherwise mutually agreed upon by ADVANTAGE
and the original retail purchaser.
5. What To Do If You Are Not Satisfied With Service:
ADVANTAGE believes you will be fully satisfied with the service
you receive. Because it is the intent of ADVANTAGE to provide
you with complete satisfaction, ADVANTAGE has added another feature
to your warranty protection. In the unlikely event that you feel
that our response to the warranty service request is not satisfactory,
ADVANTAGE offers you the opportunity to air your complaint to
an impartial dispute handling organization. What is said below
explains how this works.
If you believe ADVANTAGE has not performed as stated in this
warranty, you may submit a written description of the problems
you have encountered, along with supporting documentation, with
a copy to ADVANTAGE, to:

If your complaint is not resolved within the Bureau, Boat/U.S.
will activate the "BetterBoat" Dispute Mediation Process
and will send a complete file to a senior contact at either the
National Marine Manufacturers Association (NMMA) or the Marine
Retailers Association of America (MRAA) thus activating the mediation
under rules mutually agreed upon by NMMA, MRAA and BOAT/U.S.
The recommendations and settlement terms if any will be confidential
and will not be used in a court of law.
You may not file suit against ADVANTAGE or its dealer until
your claim has been submitted to the "BetterBoat" Dispute
Mediation Process of informal dispute resolution and a decision
has been reached or you have waited 45 days for a decision once
the filing has commenced through the "BetterBoat" Dispute
Mediation Process, whichever comes first.
6. General Provisions:
This warranty sets forth the responsibilities of ADVANTAGE
regarding its manufactured boats. Repair of defects and damage
is your exclusive remedy. This warranty is given in lieu of all
express warranties. Implied warranties, including without limitation
implied warranties of merchantability and fitness for a particular
purpose, are limited to the duration of this limited warranty.
In no event will ADVANTAGE be liable for any loss of use, loss
of time, inconvenience, commercial loss, lost profits or savings
or other incidental, special or consequential damages arising
out of the use of or inability to use the boat.
7. State Law Rights:
Some states do not allow the exclusion of limitation of incidental
or consequential damages, or limitations on how long an implied
warranty lasts. The above limitations or exclusions may, therefore,
not apply to you. This warranty gives you specific legal rights,
and you may also have other rights which vary from state to state.
